APPELLATE COURT OVERTURNS MANHATTAN JUDGE, FINDS THE DEFENDANT OWNER AND CONTRACTOR FAILED TO PROVIDE A CONSTRUCTION WORKER WITH PROPER SAFETY DEVICES

Toll Brothers latest NYC luxury building, 1110 Park Avenue located on the Upper East Side has apartments for sale starting at $18 million. One would think the building owner and contractor could afford to provide proper protection to the workers building that luxury apartment. Unfortunately, they did not despite repeated complaints by a construction worker and a Site Safety Manager about unsafe conditions at the project. As a result, that construction worker was caused to suffer...

EXPERIENCES OF A PERSONAL INJURY TRIAL ATTORNEY

Posted on September 1, 2015

It is difficult for most clients to appreciate how much a trial attorney works when he is on trial. An experienced trial attorney lives and breathes the case every day the trial starts until it is completed. Despite preparing for years on a case, when a trial is in process, you wake up each morning thinking about questions to ask each witness, arguments to make before the judge, and ways to convince the jury to find in your clients favor.

Over the past 20 years I have prepared hundreds of cases for trial and the majority of them...

It was reported the day following the terrible accident on the border of New York City that the Metro North train that killed 4 passengers and left many more terribly injured was going 50 miles per hour above the recommended speed limit for the curve where the train derailed. Whether the brakes failed, or the train operator was not paying attention, either way the MTA is responsible for the accident and injuries to all involved. Many people are still in the hospital being treated from this accident. Federal investigators are proceeding with their investigation, but further inquiry will continue during...

Metro north train derails in new york city…

Posted on December 1, 2013

Today, December 1, 2013, all seven cars of a Metro North train left the tracks heading into New York City, resulting in multiple deaths and others severely injured. One train car stopped just short of going into a river. The crash happened at 7:20 a.m. and fortunately the train was not full on a Sunday morning. There is no evidence yet indicating this was the result of anything other than negligence. In September, 2013, the Daily News reported how MTA maintenance workers were collecting overtime while leaving their shifts on personal errands instead of fixing and inspecting tracks.

The accident happened...

Car accident victims should find an experienced personal injury law firm to protect their legal rights

Posted on March 11, 2013

Recently in 2011 a client of ours received almost a half a million dollar settlement for a case that another lawyer rejected believing they could not get any recovery. The case involved a 46 year old man, Mr. R., who was employed by a car dealership to valet cars coming in for service in Manhattan. One day he was walking towards a taxi scheduled to be serviced and while opening the drivers side door he was sideswiped by a rental storage trailer hitched to a passing car. The man was first struck on his right hip and as the trailer...

$4.5 million verdict for victim of surgical malpractice

Posted on March 11, 2013

Mr. D came to the law firm of Brand Brand Nomberg & Rosenbaum with his wife because of a surgery that went very wrong. It was supposed to be a simple back surgery. However, what happened changed the lives of the couple forever. Mr. D in 2003 went for a lumbar disc surgery at a New York City hospital. During this seven hour surgery, it was alleged that the neurosurgeon improperly cut the left common iliac artery, failed to realize the mistake, and allowed the plaintiff to remain untreated as he continued to bleed internally, resulting in brain damage. The...

How to find the right personal injury lawyer.

Posted on March 11, 2013

Recently I've had many clients coming to me because they were unhappy with their legal representation. When I inquired how they found their lawyer, it was troublesome hearing their stories. Some were contacted while still recovering in the hospital bed, some were walked by their doctors to a nearby law office, and some were given business cards by workers at hospitals.

There are ethical laws prohibiting lawyers or their agents from soliciting clients while in the hospital. I recommend that all people stay away from these predatory lawyers. There are many ways to find a good personal injury attorney. However, the...

The hidden relationship between doctors, car accident victims, and personal injury lawyers

Posted on March 11, 2013

If your personal injury lawyer is telling you which doctors to treat with and what treatment to get after a car accident, this may not be the right lawyer for you. A personal injury lawyer should concentrate on the law and winning your case. Unfortunately, many law firms have arrangements with doctors offices that are not beneficial to their clients, especially with car accident victims. Essentially, the medical office agrees to refer cases to the law firm and the law firm agrees to refer patients to the doctors office.

How does this referral practice adversely affect the client? First, it means...
